These are the terms and conditions under which IOW Neuro Physio Ltd provides its services. The full services provided to you or your child will be determined by the outcome of the initial assessment.

Before agreeing to the services please read all aspects of the terms and conditions.

Drew Scally and all Physiotherapist associates working for the company are all qualified registered Physiotherapists with specialisation in Neurological Physiotherapy.

Initial Assessment

Each initial assessment takes up to 1h. You will be asked to sign a consent form for you or your child. You will be asked to disclose all your or your child’s past medical history, medication and activity level.

All assessments and treatments will be held at your own place of residence. Physical examination of you or child will take place to assess strength, muscle length, muscle tone, balance, gait and posture.

You may be asked to remove some parts of your clothing if you feel comfortable to do so. All children under 16 must be chaperoned at all times by their guardian.

After the initial assessment the treating Physiotherapist will discuss assessment findings and propose a treatment plan going forward. In some cases treatment may not be appropriate and the Physiotherapist may refer you on to another health care professional.

Treatment

I use a variety of treatment modalities in my practise. This can include:

  • Taping

  • Acupuncture

  • Manual Therapy

  • Stretching

  • Soft tissue mobilisation

  • Functional Strengthening

  • Postural advice

Not all treatment modalities are appropriate for each patient. Explanation of the treatment modality that will be used will be discussed and agreed upon prior to starting. Precautions and advice will be given as required if some discomfort is likely to be experienced.

Stopping a session

You may stop a session at any time and not continue, respectively the Physiotherapist may also stop the session if they feel you or your child is not following our reasonable instructions. You will still be liable for the full cost of the session.

Fees

Fees are confirmed and agreed upon prior to starting any assessment and course of treatment. This will be agreed via email.

Please note that you are personally responsible to pay all fees and surcharges incurred such as cancellation fees.

We are happy to accept all patients who have insurance, however we ask that you pay the full amount and claim money back for reimbursement.

Payment

Invoices are generated at the end of each month and emailed to you. This can be paid via cash, cheque or BACS transfer.

Payment should be made within 7days of receipt of the invoice.

Cancellation

If you have booked a session and you cancel with less than 24h notice or do not turn up then you are liable to pay the cost of that session. Please be aware that in many cases insurance companies will not cover fees of cancelled sessions.

Cancellation cost is at the discretion of your treating Physiotherapist.

If your session is cancelled by your Physiotherapist then you will be given another session at the earliest possible date and no payment will have to be made.

Confidentiality

All personal and business information supplied to you is confidential and none of your personal information will be shared to a third party without your consent, except where required by law or where action might be necessary to protect you or someone else.

Data protection

Elise Rawson The Neuro Physio Ltd is registered under the terms of GDPR. Registration number can be given at your request.

Limitation on our liability to you

Liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount (and not exceeding the amount you pay in total for the Services), having regard to such factors as whether the damage was due to a negligent act or omission by Elise Rawson The Neuro Physio Ltd. Nothing in these conditions will limit our liability for death or personal injury caused by our negligence or the negligence or our employees, agents or subcontractors or fraud and fraudulent misrepresentation.

Limitation and exclusion of liability

We shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, or for any loss of profit, or for any indirect or consequential loss arising under or in connection with the Services. Except as set out in these conditions, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the contract. This clause will survive the termination of the contract.

Indemnity

You agree that you will indemnify us against any and all loss or damage suffered, including any legal fees or costs, as a result of any breach of this agreement by you.

Variation

We may change any of these terms or conditions, including our fees.

Early termination

In exceptional circumstances, such as illness or other commitments, inappropriate behaviour by you/your child, refusal to be treated in a reasonable way, actual or potential conflict of interest, or other reasons, we may decide to terminate the Services early and/or refuse or be unable to provide further sessions to you/your child. In such circumstances, we shall give you reasonable notice of termination where practicable and will refund to you any advance payment made for sessions not yet provided.

Severance

If a Court or any other competent authority finds that any provision of this contract (or any part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted and the validity and enforceability of the other provisions of the contract will not be affected.

Events outside our control

We will not be liable to you as a result of any delay or failure to perform our obligations under this contract as a result of any event beyond our control including but not limited to, strikes, lockouts, or other industrial disputes, failure of a utility service or transport network, act of God, fire, flood or storm, or breakdown of machinery.

Contacting each other

If you wish to send any notice or letter then you should send it to our principal place of business, address to be given as requested. If we wish to send you a letter or notice, we shall use the address you have given prior to the Initial Assessment.

Contracts (Rights of Third Parties) Act 1999

For the purposes of the Contracts (Rights of Third Parties) Act 1999 this agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.

Disputes and governing law

If you are unhappy with the Services Elise Rawson The Neuro Physio Ltd provides, we hope that you will discuss any problems or issues with the practitioner who treated you first. If that does not resolve matters to your satisfaction, the matter will be referred to one of the Company Director who will handle the complaint.  This agreement is governed and construed by English law and the parties submit to the jurisdiction of the Courts of England and Wales.

GDPR

We are committed to protecting your privacy. Therefore we want to inform you about the data we hold on you, how it is stored and how or if it is shared with third parties.

The data we hold

For every person receiving treatment by Neuro Physio at Home we collect the following personal data when you arrange or attend your initial appointment with us:

  • Name

  • Address

  • DOB

  • Email and/or phone number

  • GP/ Consultant details

  • Medical information about your condition

  • We may ask about health insurance policies you may have.

In accordance with our professional standards and legal requirements we keep therapy notes including initial assessment findings, diagnosis, a summary of review visits and any communication received from other professionals regarding your care.

How data is used

We primarily use your data to contact you about issues pertaining to your direct care, such as arranging appointments, invoicing for services and as a legal requirement of medical record keeping.
We may use your data to seek your views/ opinions on the services we provide or notify you of changes to our service

How data is stored

We operate on a paperless basis storing all the data we collect electronically. We use password protection on all our devices and files containing personal data. Our software for storing client records supports two-factor authentication, uses off site cloud storage in servers based in Dublin and is encrypted using 256bit encryption.

Sharing of personal information

With your consent your personal information may be shared with other health professionals or relevant parties as part of your care such as providing your consultant with a progress report or a summary for your insurance company.

This information may be shared if required to meet a legal obligation or if deemed in the client’s best interests.

Accessing your information

You have the right to request a copy of the information we hold on you which we aim to provide within 30 days of the request. You can make this request by contacting us as detailed below:
